I own a house in Glendale, AZ; I have a property management company that they are OK, not 100% sometime they do mistakes. My tenant is a single mother with 2 kids she has been living in the house for 2 years. In the beginning she used to call the property management for small things like changing a light ball, trimming the bushes, I told them that I will not pay for those expenses she is not living in a hotel that she can have a " room service" I had paid for the entire bill at that time but gave them a warring. About 4 months ago someone had tried to break into the house and broke the window glass, I was billed for that and it was about $160.00, I got upset and I told the property management that I can't be responsible for her belonging she should get an insurance. I was willing to pay only 1/2 the bill-$80.00. Now I got a letter from HOA the yard gate is broken the slats need to be repaired. What do u think is responsible?I am wondering if they are careless. Her kids are teenager.

Window & gate....your responsibility 100%
her belongings ---her responsibility 100%

to cover yourself --draft an addendum to the rental contract or lease. The Addendum is that she must provide proof to you (monthly) that she has retainedand still has active "Renters Insurance"--thus covering her own belongings. you need a copy of her policy
If she does not provide this proof with the next rent payment, she will receive an immediate 30 day notice.

Renters should have insurance for their things. You should have insurance for the dwelling and liability insurance in case of accidents. If you have a lease, it should spell out who takes care of what and who pays for what. If you didn't spell it out in the lease, your tenant believed you would provide yard care and repair. You are responsible for those things that wear out-normal wear and tear-and those things damaged by your tenant-your tenant should pay for. Since your tenant was not involved or responsible for the breakin, you get the bill. It doesn't appear that you provide any type of repair and are doing your best to be a slum landlord. I would assume that the gate is probably worn out. Fix it and stop being so cheap. If you are concerned that her children are damaging the property, change the lease or do not renew and get new tenants. For some reason I don't think this is a legit question and a waste of my time. . .
