It's not in the contract and I was convinced that pumping the septic system was maintenance--which the landlord should take care of.

Unless it's stipulated in the lease that you are responsible for pumping it, it's the LL's responsibility. The landlord has a statutory and contractual obligation to provide a habitable premises. A backed up septic system renders the property uninhabitable and therefore needs to be corrected immediately -- on the landlord's dime.

The landlord may not pump every year, as it may not be necessary. Check with your local health dept to be sure that there have not been any reported environmental problems previous to your renting.

Otherwise, no. It's not your business to have it pumped, unless you have negotiated a rental amount so cheap that it's worth the cost to you. In rural NC the price can run to around $300.

The answer to your question is "who wanted it pumped, and if it was pumped, who ordered the pumping?"

The landlord is responsible for such maintenance if it is not included in your lease agreement, but if you decided to have it done on your own, they you end up paying.
