I wrote a $500 check to a small car dealer for car deposit, but I was not given the receipt, later on I checked the carfax report and I was not happy with the condition of the car, so the following day, I asked my bank to stop the check.

Is it legal or illegal to stop the check?

Thanks for the answer.

It is NOT illegal. Although it MAY be considered either fraud or civil tort depending on the tier of fact regarding the complete circumstances.

Also, if the deposit was to hold the car and a contract to that effect was signed by you, then the terms of that contract would prevail in any action at bar.

So, if you would like a relevant legal opinion on your situation, you need to provide more facts.

And there is NO SUCH LAW on automobile purchases as the three-day rule. In the vast majority of circumstances that applies to in-home solicitations.

Legal or illegal it is definately unETHICAL. The deposit was to hold the car for you which prevented them for selling it to someone else. It was intended to show your "good faith" intent to purchase the car until all the legalities were worked out. Fine to change your mind after seeing the Carfax report. You should have told the dealer you did not want the vehicle and why, then asked for the check to be given back to you. If the dealer refused, then stopping payment would have been fine. You would have had good cause to do so.

Check your state laws. In some states you have three (3) days to void a contract.

Illegal. It's a breach of contract.
