Sounds like the worst time ever to be concidering a purchase of that size in the first place, but if the title is in her name you really don't have a choice in the matter anyways. Anything that you purchase through credit is still her responsibility untill the divorce is in the court system and or there is an agreement. Do you really need to add to the situation and purchase a vehicle right now! NOT COOL! Maybe she made the money in the house and she doesn't want to pay for half of your new car! Mabye not! I belive it is not for you to choose. If you are the one making the money would you like for her to rack up credit card bills only to be split with you ???????

Talk to a lawyer. Try google or something and there are law professionals you can ask questions like that for free. If it is your vehicle, why is it in her name? If you've had bad credit, you should've at least have her co-sign. If she has the title, she legally owns the vehicle. I hope your name is on there somehow. If you have proof that you made some payments for this vehicle.. like checks, etc. you might have a shot at getting it.
You can't trade the vehicle because in the eyes of the law, it's not yours to trade. Try to work out some kind of compromise or something with her.

You are going through a divorce and the biggest thing you are worried about is getting a newer vehicle??? I think you have more important things to worry about.
How is it "your" vehicle if "she" holds the title?

Your question isn't sparkling, yet i'm going to attempt to disguise all bases. First: as quickly as she records for divorce, she is unfastened to work out everybody she needs and not be accused of adultery. it is, there is not something criminal which you're able to do to her until you have info that she became seeing this guy or woman earlier she filed for divorce. 2d: "is this perfect?" properly, in case you particularly recommend is it ethical, or is it "advantageous", then i could say No. although that's properly criminal and she or he's unfastened to do it. 0.33: that's fairly frustrating to correctly known if she became cheating with this guy or woman or if that's why she filed for divorce. that is actual, yet until you have info, forget approximately it. there's no component eating your self alive over it. bear in mind, she became in all probability unhappy for an prolonged time. human beings do not basically awaken sooner or later and choose a divorce. It builds over the years. So she could have been cheating, yet she additionally could have only been unhappy and emotionally indifferent out of your marriage for an prolonged time. She could have only began searching for companionship as quickly as she could (after submitting) and located somebody.

Wait until you are in court and the judge decides who owns the vehicle.

Why is she holding the title, and whose name is it in? If it's in your name, go apply for another title. Tell them at the clerk's office that you lost it.
