In Georgia, after one person files for the divorce, pays the money and signs the papers...how long after that does it take to be finalized? I know it depends on the circumstances but lets say it's non-contested. Once the other party is served the paperwork what happens then....say they refuse to sign them but does not get a lawyer nor do they contest it...just holds them and doesn't sign them. Will this go on forever or what will happen? Thanks.

It depends on where you live and the Judge that is hearing the case.

They may demand that a Public Notice in every newspaper in every town at every last known address just to be sure that the Court met its due dilengence requirements (unfortuanately at YOUR expense) before signing off on it being "abandoned" by the Respondent. Minimum 60 days, could be much longer, depending on how quickly your attorney provides proof of publishment as public notices in newspapers of all known cities that the Respondent has lived in previously (which could mean years).

If the Respondent has been served and their is proof of service of the papers and the just won't sign them, your attorney could request a Court Hearing and if the Respondent misses the Hearings more than once (and there is proof of service to the Respondent in each case) the Judge may grant the divorce without the Respondent's input, as they essentially have waived that right by not showing up for Court.

Depending on how much trouble your ex wants to give you, it can literally drag on in the courts for years.

30 days. Then you are given a court date (mine was 3 weeks after the 30 days).

If they don't dign the paper work, then it DOES just drag on.
