In England and Wales, the age of criminal responsibility is 10.
In Scotland, the age of criminal responsibility is 8, by virtue of Criminal Procedure (S) Act 1995, s 41. However, rather than being prosecuted in court children are far more likely to be assessed by the Children's Panel.

I think if the child is able to carry on a good conversation and you can fully understand them then they can be prosecuted. But I don't think if they're under 16 that they can go to jail
