About one month ago I was arrested by Torrance PD (Detectice Dennis Brady) for a charge that was dismissed three days later for many reasons (the county D.A. himself came up with at least 11 reasons why the charge was non-valid---last time I checked). During the course of my arrest, I remained quiet and cooperated 100% with all that was asked of me, and I mean ALL that was asked of me. The one time that I did speak out was when toys sewn by my daughters were being torn apart, one of the Torrance police officer, Officer White, approached me and asked me what was wrong. I informed her about my daughter's toys, she then passed on the word to the other 8 officers around the toys and other belongings. To my surprise, this only encouraged the destroction of the toys. The two agencies involved during the arrest were Torrance PD and US DHS ICE agents (internal affairs). Can I file and ender what grounds can I file suit against these agencies? for negligence? civil rights abuses?

The guy above me is prolly right, but I feel I have to add that the Police really need to be brought to reign, the Police (and similar agencies) have no effective checks or balances, and with political backing, our country is quickly becoming a "Police State" truly something to be hated and feared. to be avoided at all costs.

It depends. Just because the DA dismissed the charges does NOT mean you have grounds to sue. In the US as long as the officers actions where grounded in a reasonable legal position then generally they can not be sued. Also since you say internal affairs this would mean that you are employed by them, or where working with an officer for them to get involved. Since customs was involved they generally will be able to show there was reason to search the "toys". Also the federal US attorney can still bring charges against you, the DA only controls STATE charges, NOT FEDERAL ones.

Note your posting of the officers name can get YOU sued, and is also a violation of Yahoo's terms of posting. It's considered an attact on someone, and even if correct Yahoo isn't going to want to be sued because of your postings.

Very typical of cops. Yeah you got a case, but it cost a lot of money to get justice in the USA. We have the best justice system MONEY can buy. And the cops are like legal thugs.

You can file whatever you want, but if the cops had any kind of reason you might of been hiding something in these dolls or whatever they had the right to look. I guess it depends on why they arrested you.

Yes, under 42 USC 1983.

From your facts, it appears the officers deliberately damaged property that they had no reason to damage.
