it's a baby bird that hasn't fledged yet (flown)...he still has his pin (baby feathers)...poor thing...leave it alone and the parents will take care of it...

I would say a bird. A bat has claws on the tips of his wings that he would use to hole on to things not feet like the animal in the picture. But it is in a very odd position.
