BEAR WITH ME! PLEASE ;o)

about a year ago a former coworker of my sisters started accusing my sister of sleeping with her husband. my sister somewhat knew him from when she did work there, which was over 3 years ago. he sent her 2 messages on myspace which she casually responded to. It never went beyond that & there was never even any flirting in them. SO somehow this girl got sis' # so she called and harassed her a few times. my sister tried to explain that she had a fiance who was in iraq that she loved very much & that she never even spoke to her husband on the phone.

Well a few months after, my sister went to pick up a take out order @ the place where this girl still works & again she started with my sister in the restaurant & her mother did too (she also works there). so once again my sister let her know, it was not true. my sister has since seen this girl & had no problems.

Until Thursday night, sis' now ex fiance went to this same rest. to get carry out. well in the short time that he was there an employee felt the need to sit him down for almost 10 minutes & tell him that while he was in iraq my sis was ****** this girl's husband & she was spending his money on him. so he called my sister very upset & wanting to kill himself. SO being the big sister i went up there friday & kicked her ***. NOW the lady who said this to sis' fiance seen us come in & said to another "go get **** now" well everyone working there was pretty much talking about us bc she has told them all that my sister did this. and she told her manager we were there to fight her so he asked us to leave. why if she saw my sis a few months ago & was fine, would she automatically assume we were there to fight? she knows shes LIEING! Ive already typed too much lol. let me know if you need any more details. THANKS!

It's not even arguably actionable as slander, absent something much more. Having an affair with a married person is not sufficiently damaging to the reputation, unless there is something unusual about your sister (she's a nun, she's an advocate for abstinence, etc.)

What it may be is harassment. On that you'd have to check with someone familiar with the law in your state.

It's arguable defamation (slander) if the statements were made in a public place such that other people overhead. That would meet the "public statement" requirement.

But it would also need to be not just false, but harmful to your sister's reputation in the community. Not all communities would immediately dislike an accused adulterer -- that's a local standard.

From the way it sounds, the misunderstanding was kept between the immediate families of the parties involved. As long as the girl didn't go to your sister's former place of employment, her current place of employment, or other "outsiders" (media, other friends, etc...), then it's not defamation of character (also called slander).
