She came back to Virginia and tried to get custody back but failed. It's been 5 years and the kids live with us full time. The police are right. If the custodial parent does it there are no criminal charges that can be filed because the only thing they are violating is a visitation order. That is until you have custody. If you still not have found her and the judge transfers custody to you, you can then enlist the help of the police. We were told that we could even enlist the help of the FBI because once my husband had custody it became kidnapping. Most states really look down on a parent denying access to the other parent. He needs a lawyer and fast.
