My concern is for our small children. I'm finding scorpions of all sizes at least every other day. We have had professional exterminators treat the house, but to no avail. I almost stepped on one last night, and I don't even want to think out the fact that it could have been one of the kids who almost stepped on the scorpion! I am ready to move out today but with 3 months left in our lease, is this possible without any backlash from our landlord? My husband thinks I'm going overboard, but I can't handle the danger that these little critters pose to my kids and possibly to me being 6 months pregnant. I have reviewed pictures of various scorpions that call Arizona home, and I am almost positive that the scorpions I am seeing are Bark Scorpions, which are the most dangerous. HELP!

You are right and your husband is wrong, but you knew that already. You need to get the land lord or rental company on the phone and tell them to solve the problem in three days, or you are leaving. Send a letter saying the same thing. No small claims court would disagree with you as long as you have good evidence (pictures) and a paper trail.

Get the exterminator out there again too and ask them how they are getting in (there is a hole somewhere). Next, you might think about getting a cat.

Your landlord is not responsible for the scorpions invading your premises. I venture he didn't invite them there. You may run into a legal entanglement with the landlord if you attempt to vacate ahead of your lease termination date.

I would recommend calling your exterminator and advising that the treatment didn't handle the problem. Have the exterminator return and treat the premises again. You may, as well, consider asking the landlord to assist in the costs of this extermination, since a successful treatment is to his advantage as well.

You can legally break a lease but you should go through nothing less than a legal advocate. You can find free legal help on line for Arizona Tenant issues "posing hazardous living conditions."

I think you CAN move out if you can prove that you have an infestation that cannot be controlled. You have to get a letter from a professional exterminator.

if your landlord wont have them removed, then yes, as long as your lease is standard
