can you leave your half to someone in your will other than your spouse if he/she is in care? Obviously their half would go towards their care fees but can I give my half to my children? They don't live with me.

No you cannot. Joint ownership means exactly that. The surviving spouse takes it all. Otherwise you could see people put out on the street whilst in mourning, by uncaring relatives!

As Masked Landlord says,very unlikely.Many married couples with only one earning are granted a Mortgage each year.The fact you are not earning has nothing to do with your commitment to the loan as you both will jointly be responsible,the value of the loan will be based on income available IE Your husbands.Your Marriage alone will protect your share even if you do or do not make payments.It will also protect the lender from the possibility of you getting into great debt that could potentialy impact on the mortgage payments.

Yes you can. You can make it your intention that the house be sold and your half of the proceeds go to whoever you like.

It depends on whether you won it as joint tenants with rights of survivorship or as tenants in common. If you own as joint tenants with right of survivorship, the property goes to the surviving joint owner. If you own it as tenants in common, it goes to your devisees under the terms of your will or to your intestate heirs.
