I was put in jail thursday nite at 8:00p.m until fri at 10:00a.m.The problem was they said I had a writ of attatchment for a bill I was sued over.I tried to explain that the writ was released over two months ago as I was paying directly out of my check for this.The officer said oh well.They took me to jail and was not even given a phone call or anything.They would not even check to see I was telling the truth.It took my wife calling the court house and the party involved to get this fixed.I missed a whole day of work of overtime of $22.50hr.I have three children and its very hard two make it now days.Am I asking alot that they pay me for my ten hours.The Sheriff apologized but this doesnt help my pocket book.What would you do?

yes,it was for a bill.Im not a deadbeat as soom of you have stated.Im paying the bill.As for I should have followed up,well I did.Both the court as well as the party that issued it said it was released.The sheriffs dept said they never recieved a release from the court.All the deputy would have had to do is look on his computer under doxpop and saw Iwas telling the truth.Im not asking for sympathy.Ijust need to be able to support my kids.

You should have legal aid in your state that might help you.

I am curious..... Is this a civil case? In my state police are not allowed to become involved in any civil case proceedings. And if this is civil, have you considered simply filing for bankruptcy to nullify the judgment?

On the off-chance that this is an issue related to child support, there isn't' much you can do. You have to pay child support or go to jail.

This kind of thing happens a lot. A Plaintiff goes and gets a Court Order for something against a Defendant, the Defendant pays, and as far as the rest of the world knows, the Order is still valid.

Whose responsibility is it to get that Order vacated or released?

Well, let's think about that. Who has the greatest interest in the Release?

Next time anyone takes you to court for anything, make sure that all the loose ends are tied up.

I'm sorry, but this was YOUR fault for not making sure this matter was concluded on paper.

Find out who's job it was to file a notice of satisfaction for this writ. It's not the sheriffs job to check this out. His job was to find you.

Sorry you loss the work time, don't blame anyone but your self though. You should have followed up on the status of this writ when you started making payments, you should have made sure the pick up notice was removed.

I have never heard of anyone arrested for not paying a bill. Hey my due child support is almost reaching a total of 8000. Why is the dad not arrested?

I am confused. Why did they put you in jail for a civil matter. I would suggest you write a letter to the ACLU giving them the details. Be careful to tell them the facts...indignation never won a battle and tends to color the truth. .

My advice would be to stop being such a damn deadbeat and start being a man and paying your bills. Theres no excuse for your behavior
