My husband received a traffic citation and is fighting the ticket but we spaced about the court date and now we realize its on Monday. Anyway, he runs a solid surface shop and its imperative that he be at work on Monday what can we do?? We live in Phoenix if that makes a difference. How do we reschedule the hearing without getting into any legal trouble? It's Saturday night and we can't even call? I checked to see if they had somewhere I could go on line to let them know but I didn't have any luck. How much trouble will he get into if he does'nt show up and contacts them later? I hope somebody can help we're deperate. Thanks!!

Ah don't worry about it. If he posted Bond, he'll BFW @ which time the Judge will issue Warrant.

Phoenix is in Maricopa County Right? If so he'll be a guest of Sheriff Joe. Excellent he'll hit Tent City when it's what down there now 115 in the Shade.

That'a Lame Dummy excuse and I hope he gets picked up on a Warrant. Especially for you having the gaul to think he should get preferential treatment"because it's imperative he be @ work"

You have two choices, basically.

Be there, or pay the ticket.

There's a third choice IF you happen to know an attorney well enough to call them at home during the weekend and get them to appear on your behalf and try to get a Continuance, but this may wind up having you pay the ticket anyway since it's not a sure-fire thing that they will give you the delay.

The Court probably would have given you more time had you asked on Friday, but you've waited too long. You or your attorney has to be there to even have a shot at getting more time.

is this the first court date? if so, when he doesn't show up many times the prosecuting attorney will send a notice (we call them 30 day letters in KS) to appear or contact them before they ask for any type of warrant.

most traffic citation cases are losing battles though. they are not like criminal offenses (no jury). I would tend to advise that unless it was more than a traffic offense (DUI is not a traffic offense) pay the ticket and move on.

If work is so important, just pay the fine. A no show is the same as admission of guilt with court costs.

if the court date is JUST to fight the ticket and he doesnt show up, he will lose the case and have to pay the fine, and it might cost him a point or two on his driving record, this may cause your auto insurance to go up a bit.

properly if he doesnt bypass, the choose will difficulty a warrant for his arrest. He probably has one top now. If the police or sherriff doesnt get him, the surety or bondsman will (often times they act like bounty hunters). If he turns himself in, which will probably tutor the court docket that he certainly made a mistake. The longer you stall, the longer he will could bend over in penitentiary.

umm i'm not really sure but cant your husband take off work [or a home run business you take over or family member ] and go to the court date??? or you could just drop the case.

Inconvenience is not an excuse to miss court. He should go to court and cover his business obligation another way.

Forgetting is NOT a good excuse why you can't be there - you should have thought about this a few days ago.
If he doesn't show up - don't have him go and then he can expect the police to go to his work and arrest him.
