I think that if the FDA cannot guarantee that smoking while pregnant have no side effects, then yes it should be illegal. Even though it's kind of stupid one would have to be told not to harm their unborn child. WOW.

It is certainly stupid but to make it illegal you have to enforce it. What sort of penalty can you suggest for a poor pregnant lady that smokes since it would likely be a poor lady getting caught at it. A heavy fine won't stop her, she will just do it in private. Nothing less would stop them and anything more is cruel and unusual for the crime committed in my opinion.

There are too many stupid nanny laws. People need to be responsible for their own actions and don't need someone looking over their shoulders all the time.

Half the people in my age group had mothers who smoked. I remember when a friend of mine had a baby 25 years ago, there were ashtrays in the maternity ward and she was smoking her "Gaulloise" (this was in Europe) while in her hospital bed. Gaulloise is a french cigarette, it was her favorite brand. People have got to stop trying to make things illegal for others, busybodies!

Well, why not! Lets also make illegal for a pregnant woman to drink carbonated, sugar sweetened bottled soda, coffee, tea, & lets make sure she get the proper exercise so that her baby will be healthy. In fact why don't we just lock her up & monitor her & the kid until the kid is ready for school! Enough already! We have enough laws on the books that cannot be enforced; why would we need another one? Please!!!!

No.
All the statements of the anti smoking lobby are suspect due to their history of misleading statements and outright lying.
Even if their statements on this particular subject are to be believed, the risk doesn't justify a legal ban on an individuals actions.
