I am expecting a baby girl with my boyfriend and we are planning on keeping her.

would our baby take his last name or mine?

Legally a baby can't leave the hospital without a last name. If there's no dispute about who the father is, legally, it will be his last name. If he' not present, it can say any name. If the father wants to challenge it, the court will take over. Then tests will be ordered, and it could be years before your baby has an official last name. Figure this out between you two for the good of all.

It really depends on what you decide. Some married couples have kept the wife's name as the family name, some have kept the father's. There is no right or wrong to this!

Its really up to you. It can be either or you could also use both your lasts names. There is no law that says it has to be his last name. I had a baby with my boyfriend and I gave her is last name. My sister in law gave her son both or their last names so it is really up to you too what you want.

It's up to you. I was in that situation and ended up giving my son my last name, planning that if my boyfriend and I got married, my son would take on his name at the same time I did. We did not get married and my son still has my maiden name.

That is up to you to decide since your not married you can make that decision. I gave my daughter my boyfriends name and we broke up right before her 3rd birthday so I got a lawyer and am in the process of legally changing her name back to mine.

youre the mom you can put any last name you want on the birth certificate. hell you dont even have to list the father. There are no rules. Its really your choice.

Hell you dont even have to give it either one of your lasts names.

Just to make this clear. It doesnt matter if you list him as the father, or use his last name. If you use his last name, your last name, or your favorite character for shreks last name. It doesnt change the parental responsibilites by either parent.

That decision is up to you it will be what ever you put on the b/c all of my kids have my last name their dad and I were not married till the last one and I even kept my last name and our last son has my last name

That is totally up to you. My mom gave me her last name and my dads last name.

EX. First Middle moms last name- dads last name

Anyway I hope you get my drift. Its also good because when I got older I had the choice of dropping my dads last name or keeping it.

It's totally up to you. I gave my daughter my last name, because I knew I would never be with her father for very long.
I thought it would be better if we had the same last name, and I never regretted it.
