Brand new, they don't make them as fast as they used to. A mid-late 90's Trans Am can beat a current generation Mustang GT.
But if I had 40,000 and wanted a brand new car, a Mustang GT convertible is the way i would go. But yeah if you want an ugly little rice burner go with the WRX or Lancer

I say the Acura/Honda NSX. Well, it's a legend as some people say. Really nice and pretty rare. Awesome car that can give you preformance, the feel of a real sporty car, lasts a long time and save some gas.
Maybe an Acura TSX (Honda Accord Euro). A nice, full sized sedan that is really fun to drive, and cool.
Or a Nissan 350z.
Or maybe a BMW M3. They also look nice, really fast, a little common and it's awesome overall.
I can name a bunch, but insurance can kill you. ;D Anyway, here are some links to help you decide.

new, i would say mitsubishi lancer evolution, or a subaru wrx STi. Both will run the quarter mile in 13flat (EVO RS is the fastest) . Plus they offer a pretty good interior and they are sedans that will fit a few people.
Please mustang gt runs the quarter mile in 13.8, is heavy ( a bulldozer could net higher skidpad numbers) and it's totally lame. A would rather a car with years of years of rally heritage.

The new SHO! The Shelby is a lot of hype, the Trans Am's were dogs, and the 2010 Camaro 2ss is almost impossible to find for sale. The new SHO may not look the part of a sports car, but it will wax a lot of more expensive cars in a lot of different driving situations.

since you are asking I assume that 40 is tops and it needs to last a while --- go to the BMW dealer and find out how much car you can get for the $$'s .... keep shopping (( leave your name and phone ##'s) and let thrm find you the best car for the money.. beemers last and give you good service --
