Well, I think it is just like how murder is illegal, but when you kill in self-defense (and can prove it) you will not be sent to jail. If you are killing to protect yourself or others, who will blame you? Besides, this is war, and unfortunately, some terrible things happen during wartime.

The three unforgivable curses: Avada Kedavra, Crucio, & Imperio.
Avada: Only kills.
Crucio: Tortures people..maybe tot he point of death.
Imperio: Makes other people "puppets".

As far as I can remember, only Voldemort and the Death Eaters have used Avada. I know Harry has used Imperio on several characters. I dont recall anyone else using the killing curse though.
But at that time, the Ministry wasnt exactly in order...most of the people were Death Eaters or servants of Voldemort...so many people werent exactly cracking down on the killing curses being used.

The Avada Kedavra curse is a killing curse with no defense or counter. It is unforgiveable because it serves no function other than to kill.
Other spells can kill you, but as a result of their effect, not as the primary function of the spell. Killing in the magical world is still murder, but even just using or practicing an unforgiveable curse is a crime.

Look at it like this: Magic world is, sometimes, very much like the Muggle world.
Killing in either world is illegal... But self-defense killing is not.
I guess that being attacked by a death eater would qualify as a self defense situation.

i dunno. i don't think the order would use the killing curse. and i'm pretty sure molly wouldn't use the killing curse either. it said in the book that molly's spell hit bellatrix right in the chest. if you remember from the sixth book, someone hit mcgonagal (sorry with the spelling) in the chest and she had to stay at st. mungo's for a while.

As far as I know their law is like ours. Beating someone up in our world is illegal but if you catch somebody hurting a little kid and you beat them up I doubt you would get in trouble. I think the killing curse is illegal but that you can get away with it if someone is trying to kill you.

well, they were in battle, right? so it must have been ok for Mrs. Weasley to use it...otherwise they would have been dead, ALL OF THEM.. coz voldy and his gang will surely be hitting them left and right with all those illegal curses.
besides, Bellatrix deserves to be killed by the killing curse.

They don't KILL them. I guess if they're REALLY angry they would, but they probably would capture them then let the dementors suck out their soul..... but of course, the dementors stopped being on the good side...
so i guess they could've smashed them with something (ACCIO BRICKS---- then the bricks could hit the people in the head or something.....) I DONT KNOW. Read the books again if you need to.

in a situation with voldemort and deatheaters i doubt there would be any serious objections to using advada kedavara so the members of the order prolly were using it
