who in the Government. has the power to declare war....and is there anyone that can stop the idea?

Coragryph has it dead right. Only Congress has the constitutional power to declare war.

Of course them pantywaists in Congress don't have the spine of two slugs between the lot of 'em, which is why we keep getting into fights we shouldn't get into and staying' out of ones we should.

A declaration of war is a formal declaration issued by a national government indicating that a state of war exists between that nation, and one or more others. For the United States, Article One, Section Eight of the Constitution says "Congress shall have the power to ... declare War," however, that passage provides no specific format for what form legislation text must have to be considered a "Declaration of War" nor does the Constitution itself use this term.

In the USA, the President does not declare war, but can ask the Congress to. But ever since WWII, both Congress and the President have been scared to declare war, so now Congress authorizes unconstitutional "war powers" instead.

motherofthree needs to read the Contitution. The President does NOT declare war.

Its part of their "checks and balances". Congress is the only one that can declare war, but only by a formal Declaration of War request from the President.

Congress can not declare war without approval from the President (by formal request through Declaration of War), and the President can request a war but not without filing a Declaration of War and having the Congress vote on it.

"The Congress shall have Power .... To declare War, .... and make Rules concerning Captures on Land and Water;... to raise and support Armies, ... To provide and maintain a Navy; [and] To make Rules for the Government and Regulation of the land and naval Forces"

See also the War Powers Act of 1973, which limits the Executive power to act, without either a declaration of war or an authorization for the use of military force by Congress.

The President has the right to declare war and the congress can vote against it. The congress can also vote to go to war and the President can veto it.

So people who blindly blame Bush for Iraq fail to realize that there are more players involved than just scapegoat George W.

..And for good reason. Going to war is serious ****, so people SHOULD go on record officially and support or oppose the war.

The current political trend is to support it if its good and oppose it if its bad. For instance, the Dems are generally for the war but want to use it politically against Bush.

It's a crime and they need to vote, one man should not possess that power.

Congress can only declare war, Iraq is not a war it is a occupation of someones land. And the war on terror is the same as the war on poverty or war on drugs or war on the middle class.
