You shouldn't sue because you wouldn't win. The ONLY birth control that is 100% effective is abstinence. I'm guessing you were given literature on the birth control shot that explained in detail when it would become effective, as well as how effective the shot is. Sounds like you should have been more informed. Congrats on the pregnancy. Here's to hoping you don't sue the doctor if the baby turns out to be the gender you didn't want.

Sounds to me like they did everything they could at the time to assure you were not pregnant. You don't explain why you needed xrays, nor do you explain why, since you had the negative pregnancy test, you didn't (or did) have that birth control shot.

Don't assume birth defects or any reason to sue just because you had an xray. Situations like this happen all the time. It is called life. You cannot sue until damages are shown. Relax. don't be mad at the medical community. You got yourself pregant. Maybe that is where the responsibility lands.

Why would you want to sue? You may very likely have a healthy baby. No offense but its people like you who want to "sue" that kept my daughters medical case from being taken seriously and she really was injured by malpractice.

Just be happy you are pregnant, take care of yourself and your baby.

Pregnancy test are not always accurate, sounds like they did their job to check you, so it would be hard to prove malpractice in court, now if they didnt do a test at all I could see it.

more than likely you cant sue... they did all they could .. by giving you a test and then proceeding with your treatment.. they are free of responsibility... is there a reason you had an x-ray..

if your pregnant and worried about the baby's safety..that early.. there is little chance of real harm.. if your upset your pregnant after getting your shot... that is a warning.. that's why they should be kept up on and overlap.

I would first get your records from the doc you were seeing, take them to a Maternal Fetal Medicine doctor to get a second opinion. There is a good chance that if implantation had not occurred yet (ergo the neg pregnancy test), everything could be fine. I would be most worried about the x-ray. That is detrimental to a pregnancy. Once you hear what the maternal fetal medicine doc says, go to a lawyer and see if you have a case. You may have to wait until baby is born to do anything. Hang in there! Try not to worry and if you do so, say some prayers!

My friend had this happen to her and she couldnt sue anyone. She then had to make the difficult choice wether to continue the pregnancy or not. After looking at the risks and possibilities of having a disabled child she then chose to abort.

It depends on the type of xrays and the like but she found that this was the best choice for her and might not be the best choice for you. You will have to go see a doctor asap so you can be fully informed of the risks and the choices that you can make.

Good Luck.

I wouldn't sue unless the child wasn't plannned and not wanted at all, and when born it has birth defects from x-rays, and birth control shot...and etc. If the baby is healthy, and you wanted it in the end, be happy, and bless the lord that he looked over your precious child while you were carry it.

This country is sue happy, and it's ridiculous.

I am not sure if you can sue. It sounds like when you went in it was to early for them to tell if you were pregnant. There is a time when a women first conceives that not even a doctor or hospital could tell if she were pregnant.

i don't think you have anyright to sue anyone.

they gave you a pregnancy test and it came up negative. they gave you a birth control shot, now you are pregnant, you could have already been, but it just didn't show up.. now this baby might have birth defects and you might HAVE to abort it, unfortunatly. sorry for your luck, but thats all it was. the hospital covered thier bases..

good luck though
