my x has abused me and threatenes to kill me i called police and he was arrested i left st i now live in fl and am a resident he now has asked for custody the judge has ordered me and the kids to court in his st i have a restraining order against him ialso have a tape of his threatening to kill me &my family if he sees me again can my st intervene in this matter he has said the moment that i arrive there the kids will be his he is friends with the da and my attorney doesent seem to have any interest in my case

Nobody can 100% protect anyone from criminal attack.

But the judge can take all of that into account, including his threats, when determining what happens to him, and how custody is awarded.

But if you don't show up, you lose.

And if the DA is his friend, the DA cannot get involved in anything regarding him.

If you have a court order you will have to appear or loose the children. However, You can call the sheriff in that state and file a statement with them and they are to furnish protection for you. Take your whole family with you so you will have witnesses when you confront him and be sure to take a pocket recorder. You if you can record his threat in the court house the judge will deny his claim for the children. You may want your lawyer there when he makes those threats.

You need to contact a Women's rights group RIGHT AWAY to lead you in the right direction. There are lots of lawyers that will offer free services to Women in these situations. SAVE EVERY bit of correspondence from this man and write down dates and times he threatened you.Where the children ever present? Please contact a women's group in your area...the lawyer you spoke of is negligent and your life is worth more then that. Good luck and God Bless!

Get another lawyer and go down to the police headquarters and let them listen to the tape. Let them hear for themself what he is saying.
