Ok, my cousin just moved to Indiana from Ohio. She went to get her Indiana license today and the BMV refused to issue her an ID or Driver's License because the last name on her Social Security Card is A****, and the last name on her birth certficate and her Ohio Driver's License is W******.
Her parents were not married at the time of her birth, so her mother used her maiden name, W******.
However, when her parents applied for her Social Security Card they used her father's last name A****, and that was the name the Social Security Administration issued the card under.
So she went to the Social Security Administration today with all her identification papers, her birth certficate, her Ohio Driver's License and her Social Security Card. They tell her that her legal name is the one on her Social Security Card, and their computer shows that it was legally changed to A**** in 1989, but do not have hard copies oh the court paperwork. They give her an official legal affadavit, stating

Back to BMV, they tell her the affadavit from the SSA is useless.
The kicker is the Ohio License just expired and she can not legally drive now.
She ofcourse called her parents because this was her first problem ever, and they said they never filed to have her name changed to her fathers, so the SSA has put her in catch 22.
The SSA should have never issued the card with the wrong last name, and apparently just decided it had been legally changed in 1989 without it going through the courts.
She just applied to have another birth certificate under her father's name and is hoping that one is on file.
Any advice on how to fix this without hiring a lawyer?

Her parents are now divorced. There was never a court proceeding to change her name!!!! So there is no paperwork!

She needs to get a copy of the court order that granted the name change. It should be available from the court where the order was issued.

if there is a court order , she will need to show it to the DMV, i suggest that she cleans up this mess before its too late, she can have the name changed on her birth certificate and also make sure that the name on the ssc marches, it is very important that she cleans up this issue because in future she may find out that all the money she had worked for can not be accounted for, people change name all the time, its' not a hard thing to do

Her privilege as a driver should still be granted unless the Motor Vehicle office can prove non-validation of her certificates. Even when a female marries, her information changes, and they recognize that in all states. If they are failing to recognize her documentation, have a state police officer confirm her background right in front of them. Respectfully Submitted, Officer B****

The Drivers license and SSI card must match because you need two forms of ID. I don't know if her parents are married now or if she is married herself so I can't help you any further.

At P&S? usually no longer. i admire a stable chortle and somewhat much less hostility when I come here. i flow to the Politics section to make human beings seem slightly silly, R&S section to offer help and components on my ideals, and Psychology to help different people who're tousled and reassure myself that a minimum of i'm no longer that loopy =)
