He can't go to sleep without the tv on and I can't sleep with the tv on. The issue lately is he is falling alsleep downstairs, waking up in the middle of the night and coming upstairs turning the tv on to get back to sleep up stairs. He does have the sound turned off, but I still can't sleep. Does anyone have any resolution issues?

The bedroom is not a place for TV. Doctors, sexologists and Oprah W.:-) always are saying that. Also, partners suppose to go in bed in the same time. They suppose to hug each other, make love as often as they can, if not - at least kiss and saying something nice and sweet to each other...
Well, it is all true.
I had the similar problem with my ex. Have to say that that was just a little piece of other huge problem.
Yep, I got my resolution all right: he is my ex.

I have the same problem where I can't fall asleep unless I have the radio turned on or music on. Maybe you can switch him to that, rather than a glowing TV at night that's annoying.

Sometimes I use my Ipod or hook up a headset to my radio so that I don't disturb people in my house when I'm trying to go to sleep. Also, make a rule where he can't just come up from downstairs after watching TV and wake you up as he crawls into bed while you're already lights out. Hopefully the music/radio thing will help.

He goes to bed a half hour early, you go a half hour late, he sets the timer on the TV for an hour. This gives him an hour to fall asleep and the TV turns it's self off. About this time you are coming to bed, he's asleep, the TV is off and everyone is happy.

Go to sleep with the tv on sleep mode. Set it to shut off after an hour or two.

Set the timer on the TV to go off after he falls asleep. That's what I do. Hubby goes to sleep first I go to sleep with TV on so I set timer to shut it off in case i fall asleep.

Wear a night eye mask, or find somewhere else to sleep. When his bed is always cold and empty, maybe he will turn off the tube.
