questions. The search was by an FBI agent and a local sheriff's detective. The ID's appeared authentic and thier reason for wanting me to participate in the voluntary search and interview was that my internet usage had been flagged by the FBI as possible child porn trading.

I have no child porn on my system at all and did allow the search for all photos and video.

I was not read any rights other than the right to refuse the interview.

1. Can they use chat logs not on my system as evidence?
2. Would it have been legal for them to leave tracking software on my system?

The interview was not custodial (meaning it was voluntary: you were free to refuse and not prevented from leaving). Therefore no rights or warnings statements were necessary.

Because you consented to the search, they can use anything they gained from the search as evidence in any case now or in the future. That includes chat logs.

It would not have been legal for them to leave tracking software on your computer, unless they possessed a warrant permitting them to do so. However, that does not mean they can not monitor your computer usage by other means (as should be evident from their having arrived at your door.)

Anything they got from your computer includeing names of those you chatted with are evidence. By volunteering you gave up any rights that why they were not read. And while tracking software is not legal I am sure that took your IP adress and now you will be constantly surveyed...

Yes, they can use any information gained or copied from your computer during the time you consented to the search

No, they cannot install tracking software (legally) on your computer without your consent (or a warrant)

Tracking software, illegal.

They are government. Government does whatever it wants to. Fifty years of liberal rule made it so. The Americans voted for it because they wanted the perks. Now they have the results to live with- or overcome at the polling place.
