Of corse, common Law still prevails in America (Constitution and State Constitutions are common law documents), but for those who have bought into this "liscense" to marry (the state), does it make sense that you work hard all of your life, obtain wealth, only to meet someone, marry to the state, divorce, and they get half your money, when they've done NOTHING. Woman, or Man. I can see if you "marry", then the both of you go into business etc., and gain wealth, then of corse, some sort on contract should be in place, protecting the both of you. But , this is rarely the case. What do you think? I know, this has gone on for yrs.....bu it makes me wonder about having to obtain permission from government to be with the one you love.

Assets accumulated before the marriage usually stay with that original party during any divorce allocations...even in community property states.

Increases in the value of said assets after the wedding will count towards community property, so a prenup is always a good idea.

I think that when two people enter into a marriage, that divorce should be the last thing on their mind. I do understand where you are coming from though....that is why there are prenuptial agreements. I can't say that i wouldn't be offended if my husband would have wanted me to sign one....it really isn't romantic. However they say that you should keep business and personal separate and maybe this is a way to do that. Good luck to you.

anyone can have a prenuptial agreement put into place before marriage, which protects assets. you can find out more about this if you do a search on the web. this protects any assets you have pre-marriage in case of divorce.

some states no longer consider living together common law marriage, but i'm not sure which states ?

you can always protect your assets, if you do the research.

Well it is sad and wrong when that happens, and signing a prenup may hurt someones feelings if they really are in it for love, they may feel like you dont believe in them. I think it should just be a law that doesnt require any signing. Prenup should be automatic. Therefore if you come into it with money and dont wanna hurt any feelings you just automatically leave with that money. why doesnt it work like that anyways?

Prenup might help that. I would marry but I'm already married so who's to say. There are many people who don't get married and are together for years. do what makes both of you happy
