My mom filed a court order a long time ago, probably sixteen years ago, and tried getting my father to pay child support a number of times, but she never saw a dime. He refused to pay and was sent to jail. When I was younger she’d always ask me if I wanted her to file a claim to put him in jail again. That was when we didn’t know where he was and he wouldn’t call, and I’d cry because I missed him. I never wanted her to, and she only wanted what was best for me, so she just gave up on trying to collect.

I used to see him every other weekend when I was younger, and I'd go to work with him sometimes and help out, a bit ironic. Ever since I’ve know he’s always been paid under-the-table to avoid paying child support, and any other trouble he may have gotten himself into.

He has two other daughters that he’s never paid a dime to, either. The last time I spoke to him, he was living in Florida, trying to run from the law. That was two years ago, but I’m pretty sure he still lives there, probably working illegally still. I am legally an adult; does my mom have a case?

I don’t think there’s really anything effective we can do, but it’s inequitable that my mom had to work so much and so hard, she was always working when I was a child, and my father gets to get off free, collecting his own money and not helping to raise any of his children.

It sounds to me like two issues are going on here.
Relationship vs Money

There are two sides to this story Your Fathers vs Your Mothers.

Something that kids don't realize is the money is owed to the mother not to the child.

Statistics show that men who are allowed to have a relationship with their children will pay child support and pay for many other things for the children.
Men that are not allow or hinder from having a relationship with their children will drag their feet, hide income or whatever.

Child Support is an issue between your mother and father and you really should not be involved with it.

You will never have a relationship with your father if all you want from him is money.

So make up your mind what you are really after.

You can get a half hour of consultation with a lawyer -usually for free or minimum charge. You should talk with a lawyer because I think that you and your mom should sue for the money. Get (if you have the money) a Private Investigator to get pictures of him working somewhere and take those to court with you!!! Shows he's working and should be paying.Just cause you are over 18 doesnt mean he doesnt have to pay the back support your Mom was never able to collec.

Legally, he still owes child support. However it is probably such a high amount that he could never pay it. Unless the courts wanted to make an example of him, they won't do much at this point. While it has been hard for your mother, you and she have survived it. It is now time for you to move on with your lives.

Even if your father didnt pay, the state still did. If the kids are over 18, i doubt she'd have a case. He went to jail for it already, probably more than once, and seeing as he probably wouldnt have the money for it now either, he'd just go back.

Mom no longer has a case. It was never mom's money it is your money. Your father was suppose to send the money to your mom to support you. Now that you are an adult your father is obligated to pay the back owed money to you.

Of course if he has no assets and is working illegally collecting will be difficult.

If he never pain any support and you are over 18, she can collect back child support.. might even be able to use the argument about help with college.. it would mean a lawyer and you'd have to be enrolled parttime at a college.. he would prolly just be put in jail again.. but who knows..

No it is not. Unbelievably some money sucking women would ask such a question. It doesn't surprise me though...it's the typical thing...let's see how we can screw some poor guy. You might be able to sue for half the delivery fees and burial expenses depending on your state but that's as far as you go leech.

They specialize in back child support...Their fees are less than other similar companies too.

Yes, she can collect even if you are 18. It was still owed to her and they have PIs and attorneys on staff to find him and make sure he pays. They are more involved than any state child support office.......

If you know where he lives, get a current picture and make posters with

Deadbeat dad, mail them to whomever he works for, also, visit, poster them all over that town.

no...ur not a kid anymore....ur mom should have acted when u were younger...but i think u could send him to jail...for failing to pay child support during.....i dont know how long...and report him that he is wroking..illegally..
