It depends on the definition of "driving" in your state -- as strange as that sounds, that's how laws work.
Some laws define driving as being behind the wheel on a public road. Some require the vehicle to be running. Some that it has recently moved or is moving.
Your attorney (you are entitled to one) will be able to research the laws in your state and determine how to challenge the charges.

numerous DUI components are merely lacking from the direct evidence, starting to be lifelike doubt, counting on your state DUI/DWI regulations, and the a risk circumstantial evidence. Did all people see you driving? No. Did all people see you driving on a public way? No. became into there any other way your motor vehicle might are turning out to be the place it became into without you driving? sure. Case disregarded. could you be taken out and shot for DUI? sure.

Were you in the drivers seat? Were the keys in the car? Were the keys in your possession? Are there witnesses that say you were seen driving? Laws vary from state to state. Some all it takes is to be in the vehicle with the keys. Always best to get an attorney in these cases, and to remember the DOL/DMV may have issue with you that is separate from this issue and may not be resolved/dismissed even if the DUI is.

Get a lawyer, ask for a jury trial.
You will probably get out of it but it may cost you some money. If you don't get a lawyer, you will have this on your record!!
