I'm 42yrs old woman who came from other country.I hve 2nd marriage & I hve 3children with previous marriage.2 of them're above 18 and 1 is about 15.1st of all when I came to US alone,I met with my 2nd husband who also came from my country.That time he asked me to marry him because he love me and want to help my family.So we're married and I brought my children here.But after 3yrs of our married and 1yr of my childern arrived here,He said "he dont want my children to live with us" and if I don't agree with him he gonna divorce.My children is my life and they're good to him .but he show his bad mind and I have only chance to divorce.But I don't know what should I do .We hve a small bussiness with his name and we also bought a house together last yr but he controls most of our financial.So I like to know if we divorce what should I do with our estate and how can i deal with financial situtation?I can't afford a lot of money for divorce because I don't know how much can I get after that.pl

My children and I came here legeally with our own chance.so immigration status is no problem for me.I only worry about he bully me coz he controls everything.Thank for ur guys advice.its helpful and appreciate that.

You can get NO alimony until you have been married seven years in most states. The assets that are not in your name will be quite tough.....
Sorry to hear of your dilemma. Most states have a legal hotline you can call to get a referal to Legal Aid, which is low income legal assistance. If he will take everything because of the divorce, maybe someone will be able to help you....
If you are from India or some Asian counties, you can get help from the same places that help domestic violence victims from those counties if immigration is also an issue. Do a web search and you might find one in your community.

1. never choose any man over your kids not like that.. a "me or them " situation.
2. your live in the states now.. so most states are community property states, meaning u get half of anything he owns house, business etc..
the children arent his from what i could understand of ur question so u wont get any child support and more then likely u wont get any alimony because of ur length in marriage. YOU may be able to get rehabilatative alimony where he has to help pay for you to go to college if you dont have real means of a decent job. Basically he'd have to pay for u to go to school for a couple of years so u can get a decent job.
All states have legal aid. So go to ur legal aid department and they will help you. As far as your house, he will either have to sell it and give u half of what he gets for the house, or buy u out of the house if he wants to keep it.. just because its in his name doesnt mean ur not entitled to half.
Good luck but dont let him bully u into giving up your kids.

If they are not his children, child support of out of the question.
At best, you can expect a division of the assets acquired during the marriage, but this may vary depending on state law.
You didn't state your immigration status, but if he is a citizen and you are not, you could well lose your green card status upon divorce and be deported.

It depends on what stae you live in. The divorce laws are different in each state. If you have a business and a home in both of your names, contact a lawyer. He will give you the information that you need.

it depends on what state you live in as to how much of the marrital assets you can get.you should consult with a lawyer in the state you are in and he can give you a better idea of what will happen i don't think that just a consultaion will realy cost you that much and maybe you can work it out with the lawyer on paying after the divorce settlement.

half of everything. Look in the yellow pages or paper and most divorce attorney will see you and talk for free and tell you your best course of action. In the USA you are more than likely unless you cheated or caused the police to come than you get half off all assest.

if he wants divorce let him pay for it...if he files he has to pay for it...try and get your 1/2 of house financially and move on with your children and without him.
