I am in a three person partnership. 1 partner will be buying me out and will become sole owner of the company. We didn't form a buyout agreement when we formed the company a year ago. My partner said she would have a buyout agreement drafted, but I have obvious concerns with having someone else's attorney draft an agreement for me. Can I have my attorney draft one for me or is it the right of the other partner to present me with the buyout agreement he has drafted? Do I have to accept his agreement?

I realize I will definitely need to see my attorney about this one, but would like to know if anyone else has gone through the same situation.

Geez, why would you have to even think about that. Of corse you have to get your own attorney. If you you the other parties he will write it to help the other party, NOT YOU! DUH!!!

It's a lot cheaper for you to have the other attorney draft it and your attorney review it (and make modifications).

The net result is the same, but you pay less of your attorney's time.
