I got married to a foreign national from the Philippines. We were married in Japan while I was stationed there. While her investigation was being done for her visa to come here it came to our attention that she was still married to another man by Philippine law. She divorced in Japan and apparently under Philippine law they do not grant divorces, only annulments. My question is, am I still legally married here in the U.S.? Thanks to all who answer.

Well I would definitely get ahold of a lawyer and find out the specifics on your situation, but typically yes you are still married if you got your license/paperwork done in the U.S. after you got here or by a U.S. institution in Japan. (Such as a military chaplin) America does not really recognize marriages outside of the U.S, and technically she is divorced, just according to the records in the Phillipines. I have a friend in the same position. Her husband was married and divorced several years ago, but the divorce was filed in a different country than the marriage. Technically her husband is still married according to the foreign country, but in the U.S. her marriage still counts!

No. If your partner was not free to marry then you cannot be married, unless where you live allows bigamy. And I don't know if your overseas marriage would have been recognized anyway. I would go to a lawyer and get this mess sorted in case of repercussions later.
One of my uncles married a Filipino woman who was in the country on a visitor's visa, and was married for 5 years. Later he finds out that, while being told she was a widow, her other husband was alive and well, and still living in the Philippines. Immigration deported her and my uncle had to get a lawyer to sort out the mess.

Was ever consummated? and I really don't know, I had a similar issue hear in the states, but if you don't want to stay married, keep it simple and file for a divorce, that's what I did.

Ask the lawyer doing the paperwork for her visa that found the problem.

wow you got screwed really bad man. the only way you'll find out is asking a layer that deals with international situations. but i would think so.
