So we are finally getting out of our horrible apt. and gave our 30 day notice. Our last day is on the 18th and the apt. manager says we need to do the walk-thru on the 18th. She said she pre-leased our apt. so they need to get it cleaned right away. I told her since we paid for that day, we should get the whole day to move our stuff out and that we can do the walk-thru the next day. We really need the whole day to move since we only have one person helping out and have a child as well where it will be difficult to leave by 5pm. Is this legal? I didn't see anything on our lease contract about this. Thanks

That's what every apartment does.

You walk through with them and they point things you will be charged for, you sign off that this is how you left it, etc.

The problem is that your last day is the 18th. Even if you don't want to do the walk-through that day, you need to. Just get this over and done with.

Oh and they won't let you do the walk-through unless you are completely moved out. We just went through the process.

This is legal. You have to do your final walk through on your move out day. The Property Manager basically will be looking for any damages, other than normal wear and tear, and will deduct it from your security deposit. It might also be a good idea to take pictures during the walk through just in case.

You may also want to ask the propety manager if she can have the apartment cleaned and just deduct the costs from your security deposit. They usually have a cleaning crew come in anyway before the new leasee moves in. I worked for a Property Management company for several years and even if tenants cleaned their apartments before they left, the manager would still charge them for cleaning because it was never "good enough" to be considered move-in ready.

Think about this.... if you are not out by 5pm, what can they do to you? Absolutely nothing! I think you are arguing about nothing really.

Get most of your stuff out by 5pm and let the management do the walk though. They can squeeze by your boxes and do what they need to do.

Is it legal? May be it is, may be it is not. But, your argument will be very weak because there is NO damage to speak of. You can not go to court over something like this, thus the management knows it is a moot issue.

Call the Landlord-Tenant Association in your area and get the facts straight from the horse's mouth. While the good folks here want to help, they also want to tell you what you want to hear. Call Landlord-Tenant because whatever they tell you, they will, on your request, also call and tell the landlord, who must abide by their decision, whether they like it or not. Another option is to pay for the extra day and do the walk-thru a day later. Not usually a *popular* option, but an option nevertheless.

Why can't she walk through the apartment with you while you are moving? You can't spare ten minutes out of your day? Is that REALLY going to screw up your moving schedule that much?

Look at it this way. If you break something as you are moving the couch, you will already have a move-out checklist without that damage signed by the manager.

Why can't you take a few minutes to do the walk thru, surely she can tell which stuff is being moved out? She needs to see the apartment itself not the contents.

That apt is yours till 2359.59. then it reverts to the land lord. The walk thru really protects you! Take or make the time to have them walk thru with you, its your time to refute any back charges they want to charge you.

The walk thru is to protect you and them...it is also the law. If you refuse a walk thru they can keep your security deposit. I would just do it, it only takes 20 minutes and surely you have that...

call your local rent control, you should have all day of your last day of paid rent to move, she has no legal right to make you move out on the day you still are renting the apartment unless she wants to reimburse you for that day. ask her if she wants to give you the rent for that day back and you can move out on the 17th? See how that sets with her!

you are wrong. pay until the 18th, you are gone the 19th.

Since you say "horrible apt" I assume you knew you were going to leave.

move quicker.
