It depends a lot on the circumstances! If you're not happy with the parent you're living, you can requesta social worker to help you live with the other parent. That's legally.

But if you aren't happy, I'd suggest asking the parent you live in before making a legal decision!

Sometimes during the divorce, the judge will have the graciousness to ask the child their wishes. Others will make the decision based on their limited knowledge of the parents and what they believe will be in the best interest of the child.

It depends on where you live. In my state (Ohio), it is up to the judge (if the parents can't agree) to decide where you live until you are 18. If you want to live with your dad and your mom won't let you, then your dad can always ask for a hearing (or vice verse if it's your mom you want to live with). The judge would listen to what you have to say and ask you why you want to move and then make a decision based on where he/she thinks would be best suited for your needs. (I went through this when I was 13 too)

I know that in some cases the judge will ask a child where he or she wants to live if they are a certain age. If you live with your mom, but want to live with your dad then you should tell your parents how you feel. They may listen to you and let you decide where you want to stay, but be prepared they may say that you have to stay with whoever you are currently with.
