I work as a janitor. My work hours is 3:00 p0m to 12:00 am Monday thru Friday and 9:00am to 12:00 pm Saturday. I was receiving overtime for Saturday four hrs. Now my employer notified me that I will have to shorten my hours so that a total of 40 hrs. will cover Saturday. Is it legal to cut my hour during the week so that I can work Saturday to equal 40 hrs. and six days a week?

In most states, overtime is paid only for 40+ hours of work in a week. Some states, such as CA, also pay daily OT for over 8 hours of work in a day, but most do not. It is legal for the employer to ask the employee to work fewer hours per day in order not to exceed a daily or weekly overtime maximum.

Yes, it's legal by federal law - overtime has to be paid for hours over 40, but they can have you work that 40 hours spread across six, or even seven, days and still not have to pay you overtime. Your option if you don't want to do this is to find another job and quit.

There might or might not be states that mandate overtime pay in your situation, but I don't know of any. Check your state website or post again here with your state.

Absolutely. You're not entitled to overtime, you know. I can't believe you asked this.
Be happy you have a job.

Unfortunatley yes. As long as you don't go over 40hrs. They don't have to pay you over time.
