in order to take care of his girls on visits...His ex-wife says she can't have them. The power of attorney gives her the right to do everything from taking care of school things to getting medical treatment...even though the ex- wife has custody and it is shared parenting can the power of attorney help her keep visitations after they are married

No, a power of attorney is only so she can basically "sign his name". If he wants the kids with her after they are married, he has to go to court and get it in the custody agreement that step-mother gets the kids - but the mother has to agree to it...she will fight for right of first refusal, meaning that she gets the choice of where the children go if he can't take them...and it won't be with your sister.

A judge is going to keep the children with a biological parent over a step.

You don't explain whose name is on the power of attorney. If HE signed so that your sister could use HIS visitation rights, I don't think that's legal before they marry (maybe not even after).

marriage has nothing to do with this. What is spelled out in writing in the parenting plan is the final word on this.

Power of attorney only gives her rights to sign things such as adminssion to a hopital, insurance forms, legal forms.

I would imagine once the father in in Iraq the visitation will stop until he returns unless your sister is specifically mentioned in the court order. She needs to look at the paperwork from the court.

do the kids want to visit her.. ?

and why would she want to have visitation with kids who aren't hers? is she trying to cause a bunch of commotion, or world war III?

she probably needs to visit with the kids when their father is present, and stop the insanity of this power of attorney thing.

it's stupid.

Step parents have no rights to their spouses children. If their mother will not allow her to see them she recourse.

How am I suppose to know that? Just have the sister plead insanity and to file letters of incorporation.......
