If you were driving the car uninsured, you were breaking the law. In most states, the other driver wouldn't be liable in this particular case, since you shouldn't have been on the road in the first place.

If you were hit from behind, it is the other driver's insurance that should pay for you to have your damages repaired. If you do not have insurance, however, I'm not sure how that works.

Not where I come from. Their coverage may or may not pay for their damages to their car, but I would say it's time to pray on it - if they have that coverage for the damage to their car, they are less likely to try to sue you personally for your non-insurance.

if your not insured you may face a penalty or fine but if you can show that you now have insurance, that would be considered....it would depend on circumstances of the accident, i was hit while pulling out of a drive way by a speeding driver who veered on my side of the road and i was still libel...so it depends.

In every state I have lived in it's your fault if you get hit from behind. And it is the law that you have insurance.
