Do you mean that you signed an employment contract before you were hired agreeing to give 3 months' notice upon resignation and now you wish to leave without giving the 3 mths' notice? In that case, they can take action against you to recover 3 mths' pay from you or any amt they claim they lost due to your not giving sufficient notice. If you're lucky, and they were wishing you'd go anyway, they may just forget the matter and not take any action. But it's always nice to leave on amicable terms cos your next employer may check with them for reference. Couldn't you speak with your supervisor and ask for the terms to be varied, say, you give 1 month's notice instead?

Why would you need to give them 3 months' notice? If that is what is spelled out in the contract, I would keep looking for another job.
