My neighbours are trying to gain prescriptive rights over my drive just at the point of me selling my property. They are saying that they have used the drive for the last 20 years (not as a drive but as pedestrians) I would like to send an affidavit to my solicitor stating that this is untrue- does anybody know the format and content of an affidavit?

An affidavit is nothing more than a declaration or statement made before someone like a notary public, who signs it and puts his seal on it, making it a legal document.

It's a list of statements that you make under oath.

If you are sending it to your solicitor, all you need to do is send the list of statements.

Keep them short, one or two sentences, and each statement attesting (stating) one main fact.

Your solicitor will then put them into the proper document format as required by the appropriate court rules.
