I need some legal advice.
My fiance and I have been together for over a year, and found out 6 months ago I was pregnant.
Hes 19 and I am 16, I was 15 when I found out I was preggo, he was 18.
Upon coming to my new OB, they asked how old the babies father was, I told them.
They ended up calling the hotline for child abuse, because apparently they HAVE to report it, for the age difference, and that the age of consent was 16.
Orignally we were told it was 14, by a local anti-abortion clinic.
Well we got a visit from a private investigator from the Arkansas State police.
And now it is up them on what happens to him.
The investigator told us that he dealt with a case just like this last month, where no one wanted to press charges, and when it got to the prosecuting attourney it was dropped.
But we still dont know whats going to happen.
His mom has read up on stuff, and she says she found out that if we get married, that it will drop all of the charges.
So my question is, will it??

you can legally get married at 16.
I have a friend whose 16, and shes expecting so her and the babies father got married.

Only not for this reason, they are both 16.

Keeping your boyfriend out of jail is not a reason to get married.

Private investigators rarely work for the police and if they do and are directed by the police they then have to follow the same rules as the police.

What this boils down to is that your boyfriend committed a crime and apparently has no defense. It will be up to the DA to decide if he will be prosecuted. They are the only one who can “press charges”. They don’t need you or your testimony. Once the baby is born DNA will tell them who the father is and from there all you have to do is the math.
However, what you and your parents have to say will likely carry some weight with them.

You should also consider that you both will be parents soon. Part of being good parents is setting a good example. Taking responsibility for your actions is part of being a responsible adult and should be an example you want to give your children. Even if that means going to jail.

Getting married does not change the fact that your bf committed a crime, if getting married changes anything it makes that particular prosecutor less likely to bring charges because he doesn't want to break up the family, but understand there is NO LEGAL REASON for him to do so. You are just playing to his sympathies. Also remember, YOU are not the one in trouble your bf is, he is the one that broke the law not you. You must do what is best for you and your baby, DO NOT marry some one just to protect them, marry him only if its whats best for you and quite frankly 99 times out of 100 a 16 yr old marring a 18 is never a good idea.

Most likely, unless your parents file a police report they will drop it. In NO state is it legaly for a 14 year-old to have sex with someone over the age of 18. That anti-abortion clinic needs to read up on the laws. Only a few states even have 16 as the legal age of consent. If you were to get married they most likely won't do anything. It wouldn't help your situation by sending him to jail (How's he supposed to support you and baby from jail?)

Getting married wont change anything, maybe if you were married when you got pregnant it would be legal but getting married after the fact doesn't magically undue the crime he committed. If the prosecutor said he isn't pressing charges then you are probably fine. Its up to the prosecutor to bring a case and once he says he isn't then that's about it. Also, the fact that you were mistaken about the law is no defense, don't rely on legal advice from abortion clinic workers rely on anonymous people on the Internet.

if you do get married you could exercise your 5th amendment right which is basically you wont testify against your spouse..nor can they make you
