No they would not give you the newer model. It also depends on if you have a warrenty. If you don't then most of the time they won't replace the phone at all. Verizon has extras of the older phones in multiple locations so even if you have the older chocolate for a few years, they will continue to give you the older one when you go in to switch it out.
You may find though, that you can get a deal maybe even getting a new phone for free with a contract depending on your terms and conditions
