1 - Since he declared war on the US, he would be a prisoner of war.
2 - Since he directed dreadful crimes against humanity, even were he to surrender unconditionally, he would then be tried for those crimes.

If Osama Bin Laden is some how taken alive, he should be treated like a human being, after all he is the creation of the USA fighting the USSR with american weopen and blessings.
First of all there should be an open enwuiry as to who is the creator of Laden and then how, when and where did he got his training and logistic support to fight the USSR army?
Then he should be tried as an enemy combatant like the trial of the Nazi war criminals.
We don't want a second Saddam trial. For God sake don't fool the world people. The may not have the currage to speak the truth now but the days are not very far when all in one voice shal speak the truth.

strange as it may seem did you know that O,B,L. is not on the F,B,I, most wanted list? in fact the F,B,I, states flatly that there is no evidence that O,B,L, had any thing to do with 911,
we have heard all of these accusations from the politicians and of course Israel and Aipac, but since they don't do the investigating the only thing they can do is make noise,
have you ever wondered why the over 150 Israeli's that were arrested and all failed lie detector test administered by the F,B,I, were released and sent back to Israel? why? and who authorized this release? and for what reason , when some even admitted being Mossad agents, spies,???
I think should we ever capture O.B.L. he should be put on trial and given the opportunity to tell his side of the story, it may be real interesting ,and please lets have a fair trial ,

Your first mistake is to assume that we would take OBL alive. I don't see that happening for one. Second, if we took him alive, put him on trial, convicted and then excuted him..it won't change anything in the Middle East or Al Qaeda. It would only make OBL a martyr. I would much rather hear that they discovered OBL's remains after bombing a suspected hideout than to waste the money on a trial. He would still be immortalized by his followers, but there would be much less repercussions if his death were to happen in his own territory or even at the hands of his own people.

He would have a nice long trial in NYC. We would allow the victims families to come into the court and castigate him face to face.
Then he would be publically hanged at the site of the WTC.

It should be slow and cruel punishment. Tie him to a subway entrance in New York and let people take turns on him, but don't let him die too quickly. A quick execution is an easy way out.
