Yet another example of an improper use....

Executive privilege allows a person to refuse to answer specific questions on the grounds that they refer to confidential communications.

Executive privilege has NEVER been interpreted (by anyone bu Bush and Cheney) to mean you can refuse to show up in response to a subpoena.

Which means Miers and Rove have committed a federal felony by refusing to appear at all after being subpoena'd. See 2 USC 192, and 18 USC 1001.
