Here in VA, you have to file for the unemployment pay, you don't just "get" it. But you also don't just "get" it when you file for it either. The way it works here is that the company and the employee will be apart of a 3-way call with the unemployment agency, as a sort of trial. Each party basically pleads their cases as to your employment with the company, your personnel file (were you ever written up? Did you quit your job or were you fired?). From there, the unemployment agency will then tell both parties that they will mail a letter to them with the approval or no approval, and they will also give a reason as to why or why not the unemployment pay was given. If you don't get it, you can appeal your case. I'm sure it is probably a similar process in Texas as well. You'll have to contact your local unemployment agency to find out what you need to do.

In Cal, you get the benefits based on earnings from quarters from the previous fiscal year. There is usually a period you have to wait before they will accept an application, 30 days, or so.

I figure TX is about the same. Enough bureacracy to make you crazy.

Just to make sure go to the TX unemployment website.

I'm not sure about in Texas, but here in Mi. you would be able to get it. I think the employer pays into it like an insurance policy. You don't pay for it. I found a website you could research it on...

In CA you pay for it out of your taxes. And depending on how much you paid into it will detirmine how much you get from EDD.
