even if it were, it has been in use over 100 years so that would have expired. anything in common use cannot be trademarked. trademarks must be unique at the time of inception. also copyright and trademark can only be claimed for work that is original with the author. therefore only the person that originally drew that symbol has any claim on its rights, anyone alive today is much to young to make a credible claim of originality.
