My mother works as a farmhand for some guy. The guy only employs her and one other guy. Recently in Illinois, minimum wage went up. However my mother has not received the raise in pay and now makes below minimum wage.

Can anything be done? My mother needs this job but it doesn't seem legal for her boss to pay her under minimum wage.

Also, her boss is quite the jerk. So that is why she is terrified to say anything to him because he would take it out on her and make her do extra chores!

Call this number Minimum Wage Toll Free Hotline: (800) 478-3998 and ask if she is covered. In PA as a farm worker she would not be covered by PA's minimum wage. I don't know what the law is in Illinois.

Now this is where the employers have the upper hand. If you do go to the authorities, he could make it so miserable for her that she will have no choice but to quit or face the hardships that the jerk will surly be handing out to her. Her best be would be to find another job and then lay charges and if she has kept records of the hours she has worked she may be able to get these monies retroactively.

Farm employees are not subject to the minimum wage law. Go get a job somewhere else if you don't like the pay.

There are some classifications of jobs which are exempt from the minimum wage laws, agriculture is one and waitressing or serving is another.

so sorry == the employer may be a jerk but before she goes off and calls and emails and throws a fit as the others want her to do -- check the law -- you will find that farm labor is exempt from the law.. there are several other exceptions.

Best thing to do is to contact the Illinois labor department, explain the situation and ask them for advice.

If he fires her because she asks to be paid the minimum wage, she will probably be able to recover damages. Perhaps, though, she should remind him in a friendly way that the minimum wage has been raised and see what he says.

It's possible that your state allows less than minimum for agricultural employees. Check out your state's department of labor web site to be sure.

It seems to me that you and your mom have some issues to resolve before you can begin working. There may be more to it than the one heated argument. Talk to her nicely, explain your desire to have this job, your confusion with her over her sudden change of heart, and tell her you are just trying to do whats responsible. Good luck!

Tell her to visit www.dol.gov and file a claim....however, with only two employees, the boss is going to know who reported him, so she should be prepared to find something else or for him to make her life miserable if she stays....

I know she do not want to lose her job. But she want to get paid her write hourly wages then she is going to have to report him.That is against the law.
