My neighbor assaulted me in front of my home in front of 5 police officers. She plead no contest & is on 6-months probation. Our homes are attached villas. My family & I moved out because we were in fear. Now we are trying to sell our home. This neighbor walks up to potential buyers & tells them lies about our home & tells them they'd be making a mistake buying our home. We've lost 2 sales that we know of.
They also sit on their driveway, which is 1-ft. away from our driveway, chain-smoking & glaring at realtors & potential buyers with nasty looks on their faces. We've been told by several realtors that they no longer want to show our home. This housing market is difficult enough without this problem. We are still paying our mortgage, as well as a rent on an apartment because we are afraid to live there. We are in financial trouble. Everything in our home is new. We've already lowered the asking price $50,000 & have offered to pay the buyer closing costs. What can we do?

Can you talk with the police and have a no trespassing rule put on your neighbors that way they cannot go onto your property to talk to the potential buyers? Also, I know you said your villas are attached to each other, but are there any areas in the front (like maybe between the two driveways) where you could do some tall-tree/shrub landscaping?

Talk to an attorney and see if you have grounds to file a lawsuit against the neighbors to recover financial damages. You may have to get something on video with a hidden camera or at least a voice recording. For example, get a realtor to show your home to a friend who can get the recordings. The realtor could also be a witness if the attorney thinks that a lawsuit could stand up in court.

The only real recourse you have is legal action. Sue the neighbor for assault, pain and suffering. It will cost you $$ to get an attorney to take the case. Try some legal aide workshops - domestic violence advocates and anyone with clout in your community; pastor, chief of police etc.

The simple fact YOU do not want to live in your home will make it difficult for you to sell your home because of the neighbor situation. You have an association that governs the neighborhood (HOA) CDD something. Contact them, explain the assault, case number and video tape the actions of your neighbors. Your HOA should ALSO take action if they are NOT following community standards. If they are just sitting outside smoking, the HOA may not be able to do anything.

Explore your legal options. I am sorry for what you are going through. Your neighbors behavior is deplorable.

Don't approach your neighbor in any way, this may just provoke her. Get an attorney and he'll suggest something for you, it could be a letter first, tell her she can be held liable for the loss of a sale (I went through this myself)
He will also take care of any restraining order, after the sale you can still sue for the loss of any price of the house and the attorneys fees involved.

Mention to him you want her trespassed off your property and from harassing any potential customers.

File for a PFA (protection from abuse). Park a large Vehicle in you drive way and make a walking path as far away from neighbors house as possible. Inform the police before you start showing the house and when they walk around your car and onto your property film them and sue for damages and have them arrested again. Repeat as long as it takes. If your lucky the court will seize their house when they wont be able to pay damages.

If you have proof that your neighbors deterred two sales and can get those people to attest to the neighbors accusations were the reason they didn't buy your house, than you can get an attorney and sue them for defamation. Then they will be liable for all your damages as a result of their deceit.

I believe it is illegal to make false statements about a home. Kind of like slander to a human. I would contact a local real estate lawyer and have them send a certified letter stating this is unacceptable, and they will be sued if this behavior continues. If they really are doing what you say, there should be plenty of witnesses that you could bring to court. You should have no trouble winning this case. I know I had to have a letter sent to one of the neighbors of one of my listings. It worked, and we sold about 3 weeks later.

first - now that you have police reports, go to court and get a restraining order to keep her away while you are showing the house.

second - and i hate to go here...but get an attorney and now you are going to sue her for the loss of your home and the inability to sell your home, and having to incur additional living expenses.
