lets say that my mom would like to divorce my dad but my dad refuses to pay for that, and my mom has very low income, she cant afford the money to divorce, she heard that there was an office that you could go to and fill out some papers and then you would be divorced without out having to pay anything.she doesnt know were she could refer to or where that office could be so she could go. can you please help!
we are in new york, long island.

there is a child of 12 years of age, it hs been 8 years that they have been living in different places ( seperated). mom mom has asked him for divorce in the past but he has never wanted to give it to her. it is convinient for my mom to get a divorce, but its not convinient for my dad.

go to a womans clinic or battered womens shelter, they will refer her to all the woman friendly services available including lawyers that do pro bono work for abused women

Is your mom thinking of a "no fault" divorce? It's way cheaper, because she would basically just be paying for the fees to cover the paperwork...however, it really only happens when both sides are amenable to divorce and will determine "who gets what" themselves. Like an amicable divorce. Maybe you should do an online search and see if there's a women's center or women's legal help office in your area. Good luck.

I don't know about in New York but in Texas they have legal aid. Look in the phone book or try information using that. Also, some attorney's will file with no or very little down and request the the respondant (your dad) pay the petitioner's fees (your mom).

Have your mother look into We the People (www.wethepeopleusa.com). They have locations in New York and all over the country. She should also talk to some lawyers as well because some could probably work with your mother's financial situation.

I've never heard of that. Course, I've never been divorced either. I have heard that different states are less expensive than others and it also depends on what lawyer you choose.
