if there was someone right on your tail?

I do several things.....

1st: check seat belt....yep, it's on.
2nd: check speed....yep, 5 miles over the limit
3rd: brake hard for that deer I just saw cross the road....."wha' you didn't see it also?"
4th: grin all the way to work

LOL awesome! I'd do that, but the last thing I need is another dent on my car. I'd probably speed up a little, since going 5 mph above the speed limit is nothing. I haven't been pulled over yet, so I'm good. My dad has a certain thing that he says that if you're going 5 mph above the speed limit, you won't get pulled over. That's the rule I follow.

Technically yes. The speed limit is the LIMIT. In other words, the maximum speed legally allowed. Most police officers give people some leeway with the limit for many reasons. Most of those reasons involve situations where the case would fall apart in court. For example, maybe their radar gun need calibrating, maybe your speedometer is a little off, maybe there was some minor interference, etc. Maybe they just don't feel like writing the ticket, since speeding tickets are generally graded by the amount over the limit you were traveling. Generally +/- 5 miles is the rule of thumb for speed. However, even going 1 mile over the speed limit is technically illegal. If a cop wants to be a big enough dick, he can write you a ticket for it. The trick is, you can go to your court date. Every time a cop writes you a ticket, the citation will have a court date on it if you want to contest the ticket. You can go to that court date, enter in a plea of not guilty, and get another court date to argue your case. Both parties must be present for there to be a hearing. If you dont' go to your court date, the court assumes you are guilty and forces you to pay the ticket. However, and here's the fun part, the state (the cops) MUST be present as well. If you show up, and they don't, the court assumes you are innocent, and throws the ticket out. This is also why the first thing a cop will ask you when he pulls you over is, "You know why I stopped you today?" That's because if you admit you knew you were speeding, then they have a confession. You have just admitted you were guilty. That makes any defense you wish to mount more difficult. So, if you have a ticket from some jerk cop for going 3 over - Don't admit you knew you were speeding, go to your court date, and be prepared to pay the stupid thing if you have to.

5 miles over? Puh-lease!!!!! I do at least 10!!! Ooops...I speed...It's a bad habit!!! No one's ever on my tail except for the occassional police officer!! lol

If you are breaking hard and the guy behind you hits you, it is YOUR fault. You will be cited for this accident.

I have a better solution. Slow down slowly and keep slowing and it will drive them nuts.
