If you have accumulated lots during marriage you should have lawyer draw up some papers.
This happens in lots of cases one are other will start selling things.

A legal separation needs to be filed as if you're filing for a divorce, a legal separation just means that you and your spouse cannot live under the same roof due to any personal reasons and that you temporarily need time to sort out your differences. As with a divorce means there is no love between the two and you see no future with your spouse, similar to reasons for quiting a job....

It's not legal until the court where you live actually documnets it.....You will need a lawyer that they will submit paperwork and it will be documented as a legal seperation. My hubby we legally seperated and divorced a year later because that was how long they told him he had to wait. If you know you want a divorce, then go right for that. Any proceeding in court cost allot of $$$$...He would have paid half the cost if he would have just went through with the divorce instead. Good Luck!

Go to your local court, they have a library and someone there can help you get the right paperwork to fill out. Anyone can be separated, but you need to file paperwork to become "legally" separated. Plus, make sure it is separation you want. If you file to be legally separated you have to wait a year before you can file for a divorce.

OK. I know this one as I am currently separated. "Legal Separation" if I recall correctly involves having signed papers from both parties in front of the lawyer which the lawyer has filled out. But, you both need to agree to the terms in which is stated in the papers before signing. Hope this helps.

I'm hoping a genuine lawyer will sign-on here. I thought a published 'legal notice' in the newspaper was all a guy - or gal - needed for legal separation status.
Something like, "My wife (husband), having left my bed and board, I am no longer responsible for her (his) debts". Then - after an indeterminate period if the two haven't 'patched things up' they enter into divorce proceedings. How about it, Counselor?
(Oh! I think the words 'public or private' accompanied that reference to debts).

Legal Seperation, means you go through the court system to make it offical, then the next step is filing for divorce or dissoultion.
