A few months back I damaged to hood of a guys car, and he told the police that i damaged his hood, and the rest of the cars damages were from previous incidents, he was a really nice guy at the time, and now i have gotten the whole report back and he claimed 27 items totalling over $6,000 to my name. Including his fenders and rear bumper with most of his car getting repainted, plus i paid premium for his 2007 Mustang Convertable rental car. (Thats not the one they offer for free through ICBC....far off) How much of this am I responsible for? And what can I do if i want to have a legal discussion without going to court?

If he told the police that you only damaged the hood of his car, then there will be a police report stating that. Good luck not going to court over it, you really need a lawyer to has it all out for you. Clearly he's taking advantage of the fact that you caused some damage, and you better hire an auto accident lawyer before this guy starts feeling a sharp pain somewhere that he's going to turn around and blame you for, too.

If you haven't been ordered to pay for anything then that police report doesn't mean anything other than the guy told the police that you did something to his car. Take him to court like everyone is suggesting and you will probably end up paying a lot less than 6,000 bucks, which is probably more than the car is worth anyway. Better yet, make him take you.

Another option would be to turn it over to your insurance company and let them handle it. You can bet that they aren't going to pay for more than what you are responsible for. If he had that much damage done to a car that wasn't worth it they would total it out for a lot less. It sounds as though he is indeed attempting to get you to pay for something that you do not owe.

I'm a little clairvoyant. Let me concentrate.....I see small claims court in your future.

You're only responsible for what you caused at the time. Unless you can work it out with the guy, I'd have it go through small claims, so that a judge can clear out the wheat from the chaff, so to speak.

Do you have a police report? That would help clear up what happened at the time versus what was there originally.

If you only damaged his hood and he told the police that this was the only damage you caused, him claiming for other damage to his car is fraud. You can make a claim against him. Insurance companies do not take kindly to people making fraudulent claims and this is what he is doing. If you pursue this you can claim damages against him and you will probably end up better off than him.

Ask the police to investigate the other driver for filing a false police report. If he is claiming damages you did not do, it is fraud.
