The Elder Wand (it is made from the wood elder) was Dumbledore's wand. When they are at the top of the tower at the end of HBP, Draco rushes through the door and disarms Dumbledore with 'Expelliarmus'. The wand flies out of Dumbledore's hand and it immediately becomes Draco's wand, because he has overcome the previous owner, even though Draco nevers picks it up or touches it.

Draco Malfoy never actually ended up with the wand. By disarming Dumbledore the wand's alliegance switched to Malfoy but he never actually used it as he was oblivious to the fact it was now officially his wand. When Harry disarmed Malfoy, even though malfoy wasn't using the elder wand, the alliegance then switched to Harry. (A little bit too convenient if you ask me!)
They've now left it in Dumbledore's tomb so the alliegance dies with Harry as long as he remains undefeated. All it takes is someone to disarm him and the alliegance switches! If you go by the book's logic he doesn't have to be holding the elder wand so it could quite easily happen! D'oh.

Draco had disarmed Dumbledore on top of the Astronomy tower during the finale climax of the Half-Blood Prince. Which meant he actually defeated the owner of the wand. It was just speculation from everyones part that it had to be won with killing.

Draco never physically had the Elder Wand, but it was considered his since he had disarmed Dumbledore the night he died.

He disarmed it from Dumbledore... Voldemort thought Snape was the owner of the Elder wand, but Snape and Dumbledore planned his death, so he didn't earn the wand from Dumbledore...

He didn't.

The way that he was the "master" of the want, tho, is that he forcibly removed it from Dumbledore at the end of the "Order of the Pheonix". Malfoy never possessed the wand, however, and it was buried with Dumbledore.

He disarmed Dumbledore in HBP. At that point, the wand changed allegiance, though no one except Dumbledore knew at the time.

The answer given by Peta is perfect! Malfoy became the owner of the elder wand since he had defeated dumbledore by disarming him. Although snape killed Dumbledore, he didnt become the rightful owner of the elder wand (as assumed by voldy) since he hadnt defeated dumbledore! He killed Dumbledore on his own orders...his willingness to be killed by snape....This is a piece of informotion voldy didnt know since snape did a good job pretending to be on his side...thus he thought tht snape was the owner of the wand in question, when in reality, it was malfoy.

Draco ended up with the Elder Wand becuz.. he did the expelliamus.. how ever u spell it.. with..um..Dumberdore's wand. .. so that is why.. he ended up with the Elder Wand.
